Lahore: The High Court has set a hearing for the petition filed by PTI leader Hasan Niazi against the military court action.
A 2-member bench headed by Justice Syed Shahbaz Ali Rizvi will hear the petition on September 16. The court has issued a notice to the federal government on the objections of the Registrar’s Office.
The Registrar’s Office has taken the stand that a copy of the certified order of the commanding officer was not included with the petition, and the relevant forum was not consulted.
It should be noted that yesterday, the court had sought a response from the federal government on the petition against Hasan Niazi’s military custody, military court action and court martial. The case was heard by a two-member bench comprising Justice Syed Shahbaz Ali Rizvi and Justice Tariq Mahmood Bajwa.
In the petition filed through senior lawyer Faisal Siddiqui, Hassan Niazi had taken the stand that after his arrest in the May 9 case, he was not produced before any civilian court, but was illegally handed over to the army by the Sarwar Road police station.
The petition states that the notification of the commanding officer dated August 17, 2023, be declared null and void and all proceedings, including military custody, be terminated.
The petitioner has requested the court to order his release from jail or production before the Anti-Terrorism Court.
