The Islamabad High Court has issued a show cause notice to Prime Minister Shahbaz Sharif and the federal cabinet for contempt of court in the Dr. Aafia Siddiqui case.
The case related to the release, health, and repatriation of Dr. Aafia Siddiqui was heard. Justice Sardar Ijaz Ishaq heard the petition of Dr. Fawzia Siddiqui.
During the hearing, the Islamabad High Court issued a show cause notice to the federal cabinet for contempt of court. Justice Sardar Ijaz Ishaq Khan issued a notice for not submitting a report in the Dr. Aafia Siddiqui case.
Justice Sardar Ishaq said that the next hearing of the case will be on the first working day after the holidays end. The roster of judges of the Islamabad High Court is handled by the Chief Justice’s Office. The government has filed an appeal against my decision in the Supreme Court. Even if a judge wants to, he cannot work during holidays.
Justice Sardar Ijaz Ishaq said that my holidays were to start from today. I had scheduled the Fawzia Siddiqui case along with other cases today. I was told on Thursday that the cause list will not be issued until the cause list is changed. I asked the personal secretary to write a request to the Chief Justice regarding the cause list.
The judge further said that the Chief Justice did not get even thirty seconds to sign the application, in the past the roster of judges has been used for decisions of specific cases, Fawzia Siddiqui is the daughter of Pakistan, is appointed in the Supreme Court of Appeal, the judge wants to sit in the court on a holiday to provide justice.
Justice Sardar Ijaz Ishaq remarked that once again administrative power was used for judicial power, I will not let justice face defeat, I will use my judicial powers to maintain the honor of the High Court, the personal secretary told regarding the change of roster.
He further said that I told the personal secretary to send a letter to the Chief Justice because a few cases were scheduled today, Fawzia Siddiqui’s case is of a different nature, I had said that if the report is not received, I will initiate contempt of court proceedings.
Lawyer Imran Shafiq said that if the government had taken a stay, a bench would have been formed by now, we know how the High Court is functioning, your order is there, the case is scheduled in your court today.
Justice Sardar Ijaz Ishaq remarked that it is not known how your case has not been filed in the Supreme Court yet, lawyer Imran Shafiq said that the case will not be filed in the Supreme Court because Justice Mansoor Ali Shah is there, the case will be filed only when the roster of judges changes.
The Islamabad High Court has issued a contempt of court notice to Prime Minister Shahbaz Sharif, in addition to issuing a contempt of court notice to the members of the federal cabinet, the court has sought a response to the notice within two weeks.
Justice Sardar Ijaz Ishaq Khan issued a written order in which he said that the federal government has not submitted the reasons to the court despite the court order, the court has no option but to issue a contempt of court notice to the federal government.
He said that since the 26th Constitutional Amendment, the “demolition squad” was brought to this High Court, we have seen one attack after another on the pillars of justice, these attacks have repeatedly injured the justice system and almost brought it to its last breath.
Justice Sardar Ijaz Ishaq Khan said that another example of attacks on the justice system came to light today, the delivery of justice by a judge of the High Court was controlled through a weekly roster maintained by the Chief Justice’s office.
He added that this situation is both heartbreaking and humorous at the same time, a paradox that has now become the hallmark of this High Court.
Justice Sardar Ijaz Ishaq said that the court had given the government an opportunity to submit its report, had warned the Assistant Attorney General that if the report was not submitted, contempt of court proceedings would have to be initiated, the government filed an appeal in the Supreme Court against the order to file the amendment petition, for no reason the Supreme Court did not hear the government’s case.
The court said that Justice Sardar Ijaz Ishaq Khan said that the tricks of the executive were revealed elsewhere, the proceedings of this court were controlled through the roster, if a judge wants to set up a court to deliver justice, the High Court administration will not allow him during the vacation.
