The apex court suspends the IHC order barring Justice Jahangiri from judicial work

A five-member bench headed by Justice Aminuddin heard the petition of Justice Tariq Mahmood Jahangiri. Other judges of the bench include Justice Jamal Mandokhel, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi and Justice Shahid Bilal.

Islamabad: The Supreme Court’s constitutional bench today allowed Justice Tariq Mahmood Jahangiri to work and suspended the Islamabad High Court’s order to stop him from working.

The Islamabad High Court had issued an order on September 16 this month to stop Justice Tariq Mahmood Jahangiri from working as a judge in the alleged fake degree case.

The court had said that Justice Tariq Mahmood Jahangiri will not do judicial work until the Supreme Judicial Council decides on the alleged fake degree case. Justice Tariq Jahangiri challenged in the Supreme Court.

A five-member bench headed by Justice Aminuddin heard the petition of Justice Tariq Mahmood Jahangiri. The other judges of the bench include Justice Jamal Mandokhel, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi and Justice Shahid Bilal.

Justice Tariq Jahangiri himself also appeared in his personal capacity. Advocate Munir A Malik argued on his behalf. Munir A Malik, while arguing, said that ‘Justice Jamal Khan’s recent decision states that one judge cannot issue a writ against another judge. This is the first time in the country’s history that a two-member bench of the High Court has prevented a judge of its own High Court from performing judicial work. The law stipulating to prevent Justice Jahangiri should not work, was ignored. The order to prevent the judge from working did not meet the requirements of justice. On July 10, 2024, a writ was filed against Justice Jahangiri in the Islamabad High Court. More than a year has passed, and the objections of the Registrar’s Office are still valid.
