Islamabad: Supreme Court Justice Hashim Khan Kakar has questioned the Punjab government as to why they want to prosecute Pakistan Tehreek-e-Insaf (PTI) leader Sanam Javed now.
According to the British channel Dawn TV, a 3-member bench headed by Justice Hashim Khan Kakar heard the Punjab government’s appeal against the acquittal of Sanam Javed in the May 9 cases.
Justice Ishtiaq Ibrahim remarked that whatever is in the case, it is fine if we just don’t say anything, do you know tomorrow you will include my name or anyone else in the May 9 cases?
During the hearing, the Punjab government’s lawyer said that a petition was filed in the Lahore High Court against the remand of Sanam Javed. In the petition against the remand, the Lahore High Court acquitted the accused from the case itself.
Justice Hashim Khan Kakar said that instructions have been issued by the Supreme Court in these cases that a decision should be made within 4 months.
The Punjab government’s lawyer said that the High Court exceeded its powers and acquitted the accused.
Justice Hashim Kakar said that I have a decision in this regard that the High Court has all the powers. If the High Court receives any letter that injustice is being done, it can use its powers. If there is injustice, it cannot be turned a blind eye to it.
The lawyer said that the High Court cannot use its suo motu powers.
Justice Salahuddin said that the High Court also has suo motu powers in criminal revision.
Later, the court adjourned the hearing of the case indefinitely.
