Islamabad: Describing ‘27th Constitutional Amendment as a serious attack on the Constitution, Supreme Court’s senior-most judges Justice Mansoor and Justice Athar have resigned. Expressing their disagreement on the 27th Constitutional Amendment, the senior-most judges of the Supreme Court of Pakistan, Justice Mansoor Ali Shah and Justice Athar Minallah, have resigned. Justice Mansoor Ali Shah has sent his resignation to the President.
After resigning from their posts on Thursday, Justice Mansoor Ali Shah and Justice Athar Minallah have also vacated their chambers.
Justice Mansoor Ali Shah wrote in his resignation that ‘the 27th Constitutional Amendment is a serious attack on the Constitution of Pakistan, which has torn the Constitution of Pakistan to pieces.’
‘The judiciary has been made subordinate to the government, and a serious blow has been dealt to the spirit of our constitutional democracy. Pakistan has been pushed back decades by dividing the country’s only supreme court and trampling on the independence of the judiciary.
He further wrote that “remaining attached to this position would not only be tacit consent to a constitutional intrusion, but would be tantamount to sitting in a court whose constitutional voice has been completely suppressed.”
“Unlike the 26th Constitutional Amendment, when the Supreme Court had the power to constitutionally review the amendment, the 27th Constitutional Amendment has also abolished this power.”
According to Justice Mansoor Ali Shah, “In this situation, I can neither defend the Constitution nor judicially review the amendment that has distorted the constitutional structure.”
“The 27th Constitutional Amendment has torn the Supreme Court of Pakistan to pieces; the Constitution that I had sworn to uphold no longer exists.”
